I. Die VorschriftI. The Regulation
Dienstanweisung für Kommissare des Astra Militarum, Abschnitt 1, Satz 1: Der Kommissar ist bei der Truppe, nicht in ihr.
Standing Instruction for Commissars of the Astra Militarum, section 1, sentence 1: the Commissar is with the troops, not in them.
Lord-Kommissar Tammert war zweiundsechzig Jahre alt und hatte in vierzig Dienstjahren dreihunderteinundzwanzig Vollzüge geleistet, und er sagte diese Zahl in der ersten Minute, ohne dass jemand gefragt hätte.
Lord Commissar Tammert was sixty-two years old and had in forty years of service carried out three hundred and twenty-one executions, and he said that number in the first minute, without anyone having asked.

He did not say it like a man boasting. He said it like a man passing on the time of day.

Before him stood nine newly appointed Commissars in new coats that all sat exactly alike, because they all came from the same cut, and Bercht Ohlwein was the fourth from the left and twenty-two years old and had since his eleventh year not spent a night outside an establishment of the Schola Progenium.

Ein altes Regiment hat Bräuche, an denen ein Kommissar sich festhalten kann, und ein Offizierskorps, das weiß, wie man mit ihm umgeht. Eine Neuaufstellung hat nichts. Eine Neuaufstellung ist zweitausendvierhundert Fremde, die alle gleichzeitig lernen, wovor sie Angst haben.
A new formation counted as the worst thing one could draw. An old regiment has customs a Commissar can hold on to, and an officer corps that knows how to handle him. A new formation has nothing. A new formation is two thousand four hundred strangers all learning at the same time what they are afraid of.
Tammert behielt ihn danach zurück.
Tammert kept him back afterwards.

Tammert sah ihn zum ersten Mal an.
Tammert looked at him for the first time.
»Das ist die falsche Frage«, sagte er. »Sie werden welche machen. Die Frage ist, ob Sie sie zählen.«
"That is the wrong question," he said. "You will make some. The question is whether you count them."

They all looked alike, and in a way he had not expected. Not the uniform — that sat well on none of them. It was the hands. Every second hand had a thumbnail that was black or missing, and the set of the shoulders was the same in all of them: slightly forward, as though the body reckoned with a ceiling that is too low.

A regiment of miners. He had read the file note and taken it for an administrative detail.
Am dritten Tag an Bord stellte er fest, dass sie paarweise gingen.
On the third day aboard he found that they walked in pairs.
Nicht in Zweierreihen — das war Marschordnung. Sie gingen paarweise, auch wenn niemand es befohlen hatte, auch beim Essen, auch nachts zur Latrine. Not in twos — that was march order. They walked in pairs, even when no one had ordered it, at meals too, at night to the latrine too. He asked the training sergeant of the third platoon about it, a small broad man with a face like a slammed door, and received an answer he entered in his personal notebook because he could not place it:
»Weil man um zwei nicht abstimmen kann, Kommissar.«
"Because with two you cannot vote, Commissar."
Ohlwein hat drei Jahre gebraucht, um zu verstehen, dass dieser Satz das Regiment vollständig beschreibt, und weitere sieben, um zu verstehen, dass er auch sein Amt vollständig beschreibt, nur von der anderen Seite.
Ohlwein needed three years to understand that this sentence describes the regiment completely, and a further seven to understand that it also describes his office completely, only from the other side.
Ein Kommissar ist immer der Dritte.
A Commissar is always the third.
Er ist der, der übrig bleibt, damit abgestimmt werden kann.
He is the one who is left over so that a vote can be taken.
II. Der Vordruck K-3II. Form K-3
Vordruck K-3, Vollzugsmeldung des Kommissariats. Sieben Felder. Feld sechs heißt „Anlass" und nimmt eines von neun zulässigen Kurzworten auf.
Form K-3, execution report of the Commissariat. Seven fields. Field six is called "Occasion" and takes one of nine permitted short words.
Der erste Vollzug fand statt, bevor das Regiment einen Feind gesehen hatte.
The first execution took place before the regiment had seen an enemy.
Das ist häufiger, als in den Ausbildungsschriften steht. Ein Regiment, das noch nichts erlebt hat, hält sich für unbeobachtet, und die neun Kurzworte auf dem Vordruck K-3 sind nicht ohne Grund so gewählt, wie sie gewählt sind: Vier von ihnen beschreiben Dinge, die nur an Bord passieren.
That is more common than the training writings say. A regiment that has experienced nothing believes itself unobserved, and the nine short words on Form K-3 are not chosen as they are for nothing: four of them describe things that only happen aboard ship.

It was the two hundred and seventh day of the voyage. A trooper of the First Company had beaten a comrade to death with a spanner, over a matter recorded in the report as dispute over rations and that was in truth a dispute over a sleeping place beneath the ventilation, because the ventilation was the only place in the hold that smelled of anything.

Ohlwein did what the regulation requires. He established the facts, he heard the man, he pronounced the execution, and he carried it out himself, before the First Company, in the hold, at six in the morning.

He had trained for eighteen months in the Schola in how one does that. The grip. The angle. The address beforehand, which must be short, because a long address turns an execution into a performance.

What is not trained in the Schola is that a hold with two hundred people in it is not quiet after a shot. He had expected silence. It was not silent. It was full of small sounds — cloth, breath, someone shifting his feet — and those sounds went on, without a pause, as though nothing had happened, and that was exactly the worst of it: that the bodies of two hundred people carried on while they all looked.

It took eleven minutes.

Afterwards he sat in the chamber assigned to him as an office — two metres by three, a bunk, a folding table — and found that he was calm.

Not cold. Calm. The proceeding had been right. It was according to regulation, it was proportionate, it was necessary, and it was fully documented. There was no point at which he could have decided otherwise, and that absence of points was what made him calm.

The regiment had as yet no proper staff, only a table in a partitioned container room, and the Colonel — a man who had never seen Vandau and led a regiment that consisted of nothing else — pushed a sheet across to him.

"Nineteen reports," he said. "In three days. Platoon by platoon. All with the same content."

"They want the place to stay empty," said the Colonel. "Read the last sentence."

The last sentence was the same in all nineteen. It ran: The place is not to be allocated for the duration of the voyage.

Ohlwein stood with the sheet in his hand and searched the Standing Instruction for the section that fitted this case, and did not find it, because it does not exist.

"Is that mutiny?" the Colonel asked.

"I do not know, Colonel."

The Colonel looked at him, and in that look lay something Ohlwein took at the time for contempt and that was relief.

The place beneath the ventilation in hold three stayed empty for eleven months, until the end of the voyage, and nowhere in the papers of the First Vandauer Shaft Rifles does it stand why.

It was the first exception.
Ohlwein hat sie damals nicht mitgezählt, weil er sie nicht als eine erkannte. Er hat sie neun Jahre später nachgetragen, in dem einzigen Verzeichnis, das er führte, und das Verzeichnis war sein Gedächtnis, weil es für diesen Vorgang keinen Vordruck gibt.
Ohlwein did not count it at the time, because he did not recognise it as one. He entered it nine years later, in the only register he kept, and the register was his memory, because for that proceeding there is no form.
III. NissenIII. Nissen
Dienstanweisung, Abschnitt 4: Verweigerung des Vorgehens vor dem Feind ist unverzüglich zu ahnden. Ein Aufschub ist nur zulässig, wenn der Vollzug die Lage verschlechtern würde.
Standing Instruction, section 4: refusal to advance before the enemy is to be punished without delay. A postponement is permissible only if the execution would worsen the situation.
Auf Hallgart lernte Ohlwein, dass die Vorschrift von Menschen geschrieben worden ist, die niemals hundert Meter unter Fels gestanden haben.
On Hallgart Ohlwein learned that the regulation was written by people who have never stood a hundred metres under rock.
Das Regiment war den Aufständischen in die Versorgungsstollen nachgeschickt worden, weil drei Regimenter vor ihnen dort unten gescheitert waren. Ohlwein ging mit der Zweiten Kompanie, Röhre elf, weil ein Kommissar dorthin geht, wo am ehesten etwas passiert, und weil die Zweite den jüngsten Hauptmann hatte.
The regiment had been sent after the insurgents into the supply galleries, because three regiments before them had failed down there. Ohlwein went with the Second Company, tube eleven, because a Commissar goes where something is most likely to happen, and because the Second had the youngest captain.
In der vierten Stunde blieb Gardist Nissen stehen.
In the fourth hour Guardsman Nissen stopped.
Er blieb nicht zurück und er brach nicht zusammen. Er blieb stehen, mitten in der Röhre, ließ die anderen an sich vorbei, und als der Zugführer ihn anfuhr, sagte er:
He did not fall behind and he did not collapse. He stopped, in the middle of the tube, let the others past him, and when the platoon leader shouted at him he said:

"I'm not going in there, and you shouldn't either."

It was loud enough for half the company to hear. By the regulation the case was closed at that moment: refusal to advance before the enemy, within earshot of others, without necessity. Field six, short word disobedience. Ohlwein already had the weapon in his hand, because in training it is in the hand before one thinks.
Er fragte trotzdem. Er hat nie herausgefunden, warum.
He asked all the same. He never found out why.
»Warum nicht.«
"Why not."
»Weil da vorn keine Luft ist.«
"Because there's no air up front."

"How do you know that."

"I don't know it," said Nissen. "I hear it."
Ohlwein stand in einer Röhre, in der man nicht aufrecht stehen konnte, mit einer Waffe in der Hand, vor einem Mann, der behauptete, Luft zu hören, und hinter ihm warteten hundertvierzig Menschen darauf, was ein Kommissar in so einem Fall tut.
Ohlwein stood in a tube in which one could not stand upright, with a weapon in his hand, before a man who claimed to hear air, and behind him a hundred and forty people were waiting to see what a Commissar does in such a case.

"There," he said. "And there again."

Ohlwein laid his hand beside it. He felt nothing. He felt cold sheet metal.

»Sie müssen nicht spüren«, sagte Nissen. »Sie müssen zählen. Es kommt und geht. Wenn's regelmäßig kommt, ist die Röhre offen. Wenn's aufhört und einmal lang bleibt, ist vorn was zu.«
"You don't have to feel," said Nissen. "You have to count. It comes and goes. If it comes regular, the tube's open. If it stops and stays long once, something's shut up front."

They stood seven minutes at a wall and counted. A hundred and forty people waited. The captain of the Second came forward and said nothing, because he saw that the Commissar was counting.

It was no sound. It was a failure to come — a place at which something should have come and did not, and after it a long, dull sameness that felt like a room being closed from outside.

Sie kehrten um. Vierhundert Meter weiter vorn stand, wie sich zwei Tage später herausstellte, eine eingezogene Trennwand, hinter der der Luftstrom endete, und dahinter lagen die Toten des dritten Regiments, das nicht umgekehrt war.
They turned back. Four hundred metres further on there stood, as emerged two days later, a drawn-in partition wall behind which the airflow ended, and behind that lay the dead of the third regiment, which had not turned back.
Der Vorgang hätte damit gut ausgehen können.
The matter could have ended well at that.
Er ging insofern gut aus, als hundertvierzig Menschen lebten, die sonst nicht gelebt hätten, und insofern nicht, als Gardist Nissen vor Zeugen das Vorgehen verweigert hatte und der Kommissar es nicht geahndet hatte.
It ended well in so far as a hundred and forty people lived who otherwise would not have lived, and not well in so far as Guardsman Nissen had refused to advance before witnesses and the Commissar had not punished it.
Ohlwein setzte sich abends an den Klapptisch und wollte es melden.
That evening Ohlwein sat down at the folding table and meant to report it.
Es war ihm wichtig. Er wollte nicht, dass es unerwähnt blieb; er wollte, dass eine Stelle über ihm den Fall ansah und sagte, ob er richtig entschieden hatte. Er war einundzwanzig Monate im Dienst und hatte in diesem Moment noch die Vorstellung, dass es für alles eine Stelle gibt.
It mattered to him. He did not want it to go unmentioned; he wanted an office above him to look at the case and say whether he had decided rightly. He was twenty-one months in service and still had at that moment the notion that there is an office for everything.

The K-3 reports an execution. It has seven fields, and every single one presupposes that something has happened: time of the execution, place of the execution, name of the person concerned, rank, occasion, witnesses, signature. There is no field for an execution that did not take place, because a form that reports what has not happened would need infinitely many lines.

He searched the volume of regulations for a report for the postponement. There is one: section 4, sentence 2. It is meant for cases in which the execution would worsen the situation — a demolition man in the middle of a disarming, a driver in action. It is a postponement, not a waiver. It requires the carrying out to be made good as soon as the situation permits, and it has a field for that: Made good on.
Ohlwein saß bis nach Mitternacht vor diesem Feld.

Im dritten Dienstjahr setzte Bercht Ohlwein eine Anfrage auf und schickte sie auf dem Dienstweg an das Kommissariat des Sektors. Sie war neunzehn Zeilen lang, sie nannte keinen Fall und keinen Namen, und sie stellte eine einzige Frage:
In his third year of service Bercht Ohlwein drew up an enquiry and sent it by the official channel to the Commissariat of the sector. It was nineteen lines long, it named no case and no name, and it put a single question:

He discarded four versions. The first was too long. The second read like a complaint. The third contained Nissen, which made it unusable, because it would then have been a charge against Nissen and against himself. The fourth was too cautious; it put the question in such a way that one could answer yes without saying anything.

The refraining from an execution is not a proceeding but the absence of one. The administration cannot record absence without holding a line ready for every action not taken, which makes the number of lines indeterminate.

So there was a way. There was exactly one, and it did not lead to anyone examining his decision, but to someone examining him — and not the decision in the case of Nissen, but the question whether a Commissar who asks such questions is still bearable.

Ohlwein hat auf diese Frage damals nichts geantwortet, und die Antwort, die er zwölf Stunden später im Bett fand und niemandem mehr sagen konnte, lautete:

Because a sentence that cannot be refuted is not therefore without consequences. The ruling was right. And from its rightness it followed that in the whole Imperium there was not one single office that could tell him whether he had wrongly let a man live.

In his fourth year of service he began to order them.
Nicht schriftlich. Im Kopf, und zwar nicht nach Datum, sondern nach Grund, weil ein Datum nichts prüft. Er legte vier Gründe fest und ordnete jeden Fall einem zu, und wenn ein Fall in keinen passte, dann war das ein Zeichen, und er ging ihn noch einmal durch.
Not in writing. In his head, and not by date but by ground, because a date tests nothing. He laid down four grounds and assigned every case to one, and if a case fitted none, then that was a sign, and he went through it again.

V. Die Vierte SohleV. The Fourth Level
Dienstanweisung, Abschnitt 1, Satz 2: Vertraulichkeit zwischen Kommissar und Mannschaft ist zu vermeiden. Sie beschädigt beide Seiten.
Standing Instruction, section 1, sentence 2: familiarity between Commissar and men is to be avoided. It damages both sides.
Die Ersten Vandauer nannten sich selbst nie bei ihrem Namen. Im Schriftgut steht Erste Vandauer Schachtschützen; im Mund der Mannschaft hieß das Regiment die Vierte Sohle, nach dem Schacht einer einzigen Siedlung, aus der nicht einmal ein Zehntel von ihnen stammte.
The First Vandauer never called themselves by their name. In the papers it stands as First Vandauer Shaft Rifles; in the mouths of the men the regiment was called the Fourth Level, after the shaft of a single settlement from which not even a tenth of them came.

In those years he learned a language that stands in no dictionary. The face holds meant that the situation was holding. There's a draught meant that something was wrong, and that before anyone could say what. He's out meant that someone was dead, and it was said without any bitterness, which appalled him in the first year and which in the fifth he said himself.

Twice a man was transferred before Ohlwein learned the reason, and both transfers were formally impeccable.

At the traffic junction of Gramm the regiment lost a hundred and ninety men in one morning, and that afternoon Bercht Ohlwein carried out his fourth execution.

The situation was simple and described the same way in every report: a bridge, a silo, six days of bombardment, on the seventh the order to disengage, and during the disengagement a collapse that buried the road beneath it.

Dienstanweisung, Abschnitt 12: Die Amtsführung des Kommissars wird alle fünf Jahre durch einen Vorgesetzten des Kommissariats geprüft. Grundlage der Prüfung ist das Schriftgut.
Standing Instruction, section 12: the conduct of the Commissar's office is examined every five years by a superior of the Commissariat. The basis of the examination is the paperwork.
Hauptkommissar Veldt kam im Frühjahr 933 an Bord, blieb neun Tage und war der höflichste Mensch, der Ohlwein je begegnet ist.
Senior Commissar Veldt came aboard in the spring of 933, stayed nine days and was the most courteous man Ohlwein ever met.
Er war Ende fünfzig, hatte einen Mantel, der zweimal geflickt und beide Male gut geflickt worden war, und er begann die Prüfung damit, dass er sich in Ohlweins Dienstkammer setzte, in der es nur einen Stuhl gab, und diesen Stuhl Ohlwein anbot.

He did not do it, and the reason was not cowardice, at least he saw it that way to the last: a self-report would have made the thirty-four cases into charges. They would have been examined — but not as to whether the decision was right, rather as to whether the Commissar is fit. That is not the same question. In thirty-four cases the same word would have stood at the end, and that word would have contained nothing of what he had examined every week for thirteen years.

A number alone is harmless. It burdens no one, it accuses no one, without the cases it cannot even be understood. It is only a number, and a man can carry it about with him without gaining anything from it and without carrying anything by it.

Auf Immerhalt bekam Bercht Ohlwein einen Platz.

Es war ein Vorgang von drei Zeilen. Der Stab der Ersten Vandauer Schachtschützen war am neunten Tag der Räumung auf achtzehn Personen zusammengeschmolzen, für achtzehn Personen lag eine Zuweisung vor, und Ohlwein stand darauf, weil Abschnitt 17 ihn zum Kader zählt.
It was a proceeding of three lines. The staff of the First Vandauer Shaft Rifles had by the ninth day of the evacuation shrunk to eighteen persons, for eighteen persons an allocation existed, and Ohlwein stood on it, because section 17 counts him with the cadre.

Ohlwein learned that on the sixth day, not on the ninth, and he learned it not through a communication but through the absence of one. He had asked after the figures, three times, and had three times been referred to another office, and the fourth time an overtired liaison officer simply pushed the list across to him, because he was too tired to observe regulations.

A Commissar who knows that has by the regulation one single task: to see to it that the troops do not learn it until the mission is fulfilled. That does not stand so in section 17. It stands in section 2, in the sentence about the maintenance of fighting strength, and every Commissar knows how that sentence is to be read in such a situation.

Reuel did not know that. He had probably forgotten the incident; it had been a matter of two minutes, and the decision that let him live no one but Ohlwein had noticed, because it consisted in not writing a report.

"Why me?" Reuel asked.

Then Guardsman Reuel went up the ramp, and Commissar Ohlwein went back into the underpass, and neither of them turned round, because in that regiment no one turned round; that counted as a sign that one reckons with coming up.

Der Vorgang lief 937 an und wurde 946 eingestellt, ohne abgeschlossen zu sein, weil die Streichung einer Einheit die Sektorenzuordnung ihrer Aushebungswelt voraussetzt und Vandau keine hat. Die Akte trägt seither den Vermerk schwebend; das Regiment steht auf der Schwebeliste und ist damit versorgungsberechtigt, ohne zu bestehen.
The proceeding began in 937 and was discontinued in 946 without being concluded, because the striking off of a unit presupposes the sector assignment of its recruiting world and Vandau has none. Since then the file bears the note pending; the regiment stands on the pending roll and is thereby entitled to supply without existing.

From that a series of things follows that no one intended.

Reuel knew most of the names. For two hundred and forty he could give a circumstance. For the rest he said "unclear", and Marbach wrote unclear, and both times it was the same word for something entirely different.

Marbach sah ihn an, und weil er siebenundzwanzig war und im vierten Jahr in einer Abteilung saß, die nie zu einem Ergebnis kam, tat er etwas, wofür er keine Befugnis hatte: Er schrieb die Zeile trotzdem.
Marbach looked at him, and because he was twenty-seven and in his fourth year in a department that never came to a result, he did something for which he had no authority: he wrote the line all the same.

"Don't know," said Reuel. "He said it's nothing. He said I shouldn't write it down."
Marbach saß mit dem Federhalter über Feld vierzehn.
Marbach sat with the pen over field fourteen.
Feld vierzehn heißt Bemerkungen und ist zwei Zentimeter hoch. Es ist das einzige Feld auf dem Vordruck M-9, das keine Vorgabe hat, und in der Ausbildung wird gelehrt, es leer zu lassen, weil ein gefülltes Bemerkungsfeld eine Nachfrage auslöst und eine Nachfrage die Bearbeitungszeit verdoppelt.
Field fourteen is called Remarks and is two centimetres high. It is the only field on Form M-9 that has no specification, and in training one is taught to leave it empty, because a filled remarks field triggers an enquiry and an enquiry doubles the processing time.
